These Terms and Conditions regulate the download, access, and use of the mobile application Becoming (hereinafter, the “APP”), which Apparent Group Limited owns and makes available to users on Google Play (Android) and Apple Store (iOS).

The user acquires this condition by downloading and using the APP. By accessing the APP, the user acknowledges having accepted and consented unreservedly to these terms of use and privacy policy.

1. RESPONSIBLE FOR THE APP

Apparent Group Limited, Company Registration number 73428962, (hereinafter “Becoming” or “we”), with registered office at FLAT/RM 0 5 – 0 6 HOLLYWOOD PLAZA, 6 1 0 NATHAN ROAD, 1 8 / F, KL, Hong Kong and email: hello@apparentgroup.co is the owner and responsible for the APP.

2. OBJECT

The APP has been developed to serve as a comprehensive daily affirmation and manifestation platform. Its purpose is to provide users with a highly personalized path to foster positive mindset shifts, achieve personal goals, and enhance overall well-being by combining technology with established mindfulness and affirmation practices.

3. COMPATIBLE DEVICES

The APP is available on Google Play (Android) and the Apple App Store (iOS). The user acknowledges and agrees to comply with all applicable terms and conditions of the respective application store regarding obtaining, downloading, and updating the APP.

4. GETTING STARTED

When starting the APP for the first time, the user will be guided through an in-depth onboarding quiz. This quiz is designed to understand the user’s current emotional state, life goals, aspirations, and primary challenges (e.g., self-doubt, anxiety). This information is essential for creating the user’s personalized experience.

The APP operates on a freemium model. Users can access core features with a free version. To unlock all features, including the full library of audio sessions, advanced personalization, and other premium content, the user must subscribe to the Premium version (“Becoming Plus”). Payments are processed through the payment options offered by the Google Play Store or Apple App Store.

5. METHOD OF USE

The APP is structured around several key features designed to provide a holistic and personalized mindset coaching experience:

  • Personalized Path: Based on the initial onboarding quiz, the APP creates a unique path for each user, tailoring affirmations, guided journeys, and content to their specific needs and goals.
  • Daily 10-Minute Guided Journeys: Short, powerful, and accessible audio sessions designed for daily practice to shift mindset, reduce negative self-talk, and build positive habits.
  • Subconscious Reprogramming Audios: Hour-long audio sessions for deeper, transformative work, designed for use during the day or night to help integrate positive beliefs at a subconscious level.
  • Mood & Manifestation Journal: A private digital journal where users can track their daily mood, log progress on their manifestations, and reflect on their personal growth journey.
  • Intelligent Affirmation Delivery: The APP uses technology to reinforce a positive mindset throughout the day via:
    • AI-Powered Push Notifications: Timely and relevant affirmations are sent to the user’s device.
    • Home & Lock Screen Widgets: Display affirmations directly on the user’s device for constant, glanceable reinforcement.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights over the APP are owned by Apparent Group Limited. The user acknowledges that the reproduction, modification, distribution, or decompilation of any of the elements and utilities integrated within the development constitutes an infringement of the intellectual property rights of Apparent Group Limited.

6.1 User Content

Through the APP, users can create and store their own content within the Mood & Manifestation Journal, including text entries, mood logs, and manifestation notes (hereinafter “User Content”).

Users are solely responsible for the User Content they create. By creating User Content within the APP, you represent and warrant that you own it and that it does not violate the rights of any third party. You retain all of your rights to any User Content you create. You grant Becoming a limited license to store, process, and display your User Content solely for the purpose of providing the APP’s services to you. Your User Content is treated as confidential and is not shared publicly.

7. PRIVACY POLICY

In compliance with applicable regulations on personal data protection, we inform you that personal data provided by our users will be processed by Apparent Group Limited as Data Controller.

7.1 What personal data do we process?

We process data you provide to us and data we collect automatically.

  1. A) Data You Provide Directly:
  • Account Information: Name (optional), email address, and password to create and manage your account.
  • Onboarding & Personalization Data: Your responses to our onboarding quiz, which may include information about your emotional state, life goals, personal challenges, aspirations, and areas you wish to improve (e.g., self-doubt, anxiety, confidence). This may be considered sensitive personal information.
  • Journal Data: All entries you make in your Mood & Manifestation Journal, including text, mood selections, and manifestation progress notes. This is also considered sensitive personal information.
  1. B) Data We Collect Automatically:
  • Log and Usage Data: Information about your activity on the APP, such as which guided journeys you listen to, the frequency of journal entries, features you use, and interaction with notifications. This also includes device event information like crash reports.
  • Device Data: Information about your mobile device, including device identifier, model, operating system, and IP address.
  • Push Notifications: We may request to send you push notifications. You can disable these in your device settings.

7.2 Purposes and Legal Basis for Processing

Your personal data will be processed for the following purposes:

  • To Provide and Personalize Our Services: To create and deliver your personalized path, recommend relevant affirmations and guided journeys, power the AI-driven notifications, and store and display your journal entries. The legal basis is the performance of the contract between you and Becoming.
  • For Analytics and Service Improvement: To understand how users interact with the APP in order to improve the user experience, develop new features, and conduct research. The legal basis is our legitimate interest in improving our services.
  • To Communicate With You: To send you service-related notifications and support messages. The legal basis is the performance of the contract.
  • For Marketing and Promotions: To send you information about new features and promotions, with your explicit consent.

7.3 To whom do we provide your personal data?

We only share your data with third-party service providers who are strictly necessary to operate our APP. These include:

  • Cloud Storage and Backend Services: For secure data storage of your account and journal entries (e.g., Amazon Web Services, Google Cloud).
  • Analytics Services: To help us understand app usage (e.g., Google Analytics, Mixpanel).
  • Payment Processors: To handle subscriptions (i.e., Apple and Google).
  • AI/ML Service Providers: To power the intelligent delivery of push notifications. We take steps to ensure data is handled securely and, where possible, in an anonymized or aggregated form.

7.4 Minors

The APP is intended for users who are at least 13 years of age. We do not knowingly collect personal information from children under 13. If you are between 13 and 18, you may use the app only with the involvement and consent of a parent or guardian.

7.5 International Transfers

Our company is registered in Hong Kong. We use global third-party service providers that may be based in other countries. By using our APP, you acknowledge that your personal data may be transferred to, stored, and processed in countries outside of your residence. We take appropriate measures to ensure your data is protected.

7.6 Exercise of Your Rights

You have the right to access, rectify, delete, or request the portability of your personal data. To exercise these rights, please send a written communication to hello@apparentgroup.co.

7.7 Security

We implement appropriate technical and organizational security measures to protect your personal data from alteration, loss, or unauthorized access.

7.8 Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The updated version will always be available in the APP.

8. RESPONSIBILITY & DISCLAIMER

Becoming provides content and tools for self-help, learning, and personal growth purposes only. The APP is not a substitute for professional mental health advice, therapy, diagnosis, or treatment. It is not a medical device or healthcare provider.

Always seek the advice of your physician, therapist, or other qualified mental health provider with any questions you may have regarding a medical or mental health condition. Never disregard professional advice or delay in seeking it because of something you have read or experienced on the APP.

9. NULLITY AND INEFFECTIVENESS OF THE CLAUSES

If any clause included in these Terms and Conditions is declared totally or partially null and void, such nullity shall only affect that provision, and the rest of the Terms and Conditions shall remain in force.

10. APPLICABLE LAW AND JURISDICTION

These terms will be governed by the laws of the Hong Kong Special Administrative Region. Both parties submit to the exclusive jurisdiction of the courts of Hong Kong.
